Helping North Texans Erase Criminal Records

Can teens face sex crime charges?

On Behalf of | Apr 15, 2025 | Sex Offenses

Teens can face sex crime charges in Texas. The law does not automatically excuse minors from criminal responsibility in these cases. Depending on the circumstances, the court can charge teens in juvenile court or even try them as adults.

This can lead to serious consequences, including a permanent criminal record and sex offender registration.

How Texas handles teen offenders

In Texas, anyone aged 10 or older can be charged with a crime. For sex-related offenses, this includes charges like sexual assault, indecency with a child, or possession of child pornography. Most teen offenders go through the juvenile justice system, which focuses more on rehabilitation than punishment. But in more serious cases, prosecutors can request that a teen be certified as an adult. That means facing adult-level penalties, including prison time.

What counts as a sex crime for teens

Teens can face charges for actions that might not seem criminal to them. This can include sexting, consensual relationships with younger teens, or even inappropriate touching. In Texas, the law has a close-in-age exception (“Romeo and Juliet” law) for consensual sex between teens who are close in age. However, this doesn’t prevent charges in every situation, especially if the age gap is too wide or if there’s evidence of coercion.

How charges can affect a teen’s future

A sex crime conviction can follow someone for life. Even juvenile records, while often sealed, can affect school, jobs, and housing. Some teens may have to register as sex offenders, which limits where they can live and work. These long-term consequences make it important to understand what the law allows and how it applies to teens.

Why understanding the law matters

Texas law treats some teen behavior as criminal, even if it’s common among peers. Knowing the risks can help you avoid life-altering charges. If you’re a parent or teen, take time to learn how the law works before problems arise.
